Cancellation & Refund Policy

Effective Date: January 26, 2026

1) Overview

Spot & Eat facilitates orders and bookings between customers and independent partners (restaurants, food trucks, and venues). Because orders involve freshly prepared food and reserved time, many purchases are not returnable and some are non-refundable.

Refund eligibility is subject to when the order/booking is placed and the scheduled fulfillment or Event Date/Time.

2) Returns Policy

Food Orders

  • No returns on food items once prepared, picked up, or delivered.
  • If there is a verified issue (non-delivery or missing major items), you may be eligible for a refund or credit under this policy.

Venue Bookings / Services

  • No “returns.” Refund eligibility depends on cancellation timing and the partner terms shown at checkout.

3) 48-Hour Non-Refundable Rule (Order Placement)

Any catering order, event booking, or scheduled service placed within forty-eight (48) hours of the scheduled fulfillment or Event Date/Time is non-refundable.

This applies even if the customer later cancels.

4) Event Cancellation & Refund Scale (Orders Placed More Than 48 Hours Before Event)

If the order/booking was placed more than 48 hours before the scheduled Event Date/Time, refunds are based on when the cancellation request is submitted:

  • 21+ days before Event Date/Time: 100% refund
  • 14–20 days before: 90% refund
  • 7–13 days before: 75% refund
  • 3–6 days before: 50% refund
  • More than 48 hours but less than 3 days before: 25% refund
  • 48 hours or less before: No refund

The stricter rule controls: If the order was placed within 48 hours of the Event Date/Time, it is non-refundable regardless of the cancellation timeline.

5) Regular Food Orders (Pickup/Delivery)

  • Before the order is confirmed/accepted: cancellation may be eligible for a refund.
  • After confirmation/acceptance: cancellation may be limited or unavailable if preparation has started.

6) When Refunds May Be Approved

Refunds may be approved when:

  1. Partner Cannot Fulfill (partner cancels, closed, cannot provide confirmed order/booking)
  2. Verified Payment/Platform Error (duplicate or incorrect charge caused by a technical issue)
  3. Non-Delivery (Delivery Orders Only) (verified non-delivery with correct address and customer availability)
  4. Material Issue Verified Promptly (missing major items or total service failure, supported by evidence)

7) When Refunds Are Typically Not Approved

Refunds are typically not approved for:

  • Change of mind after confirmation and preparation begins
  • Incorrect address or customer unavailable at delivery time
  • Minor quality preferences (taste/spice) without clear failure to provide ordered items
  • Delays outside Spot & Eat’s control unless confirmed non-delivery
  • No-shows for bookings/reservations

8) How to Request a Refund

Email Justfood@spotandeat.com with:

  • Order/booking number
  • What happened + why you’re requesting a refund
  • Photos/proof (if relevant)
  • Best contact number

9) Refund Timing

Approved refunds are returned to the original payment method. Many refunds post within 5–10 business days after approval (timing depends on your bank/payment provider).

10) Payment Disputes / Chargebacks

If a dispute is filed with a payment provider (including PayPal), Spot & Eat may submit transaction records and evidence including order confirmations, communications, delivery proof, and the policy accepted at checkout.

2) Information We Collect

Provided by you: name, email, phone, account details, order/booking details, partner onboarding details (business info and verification).

Automatically: device info, IP address, usage data, cookies.

Payments: payments are processed by payment providers (e.g., PayPal). Spot & Eat does not store full card numbers.

3) How We Use Information

  • Provide and improve the platform
  • Process transactions and communicate updates
  • Customer support and dispute handling
  • Fraud prevention and risk management
  • Legal compliance

4) How We Share Information

  • With partners to fulfill orders/bookings (only what’s needed)
  • With payment processors to process transactions and handle disputes

5) Data Retention

We retain information as needed for operations, dispute handling, fraud prevention, and legal compliance, then delete or anonymize when no longer required.

TERMS OF SERVICE

1) Agreement to Terms

By using Spot & Eat, you agree to these Terms and all referenced policies. If you do not agree, do not use the platform.

2) Marketplace Model (Use This Wording Everywhere)

Spot & Eat is a marketplace platform that connects customers with independent restaurants, food trucks, and venues. Customers place and pay for orders/bookings through Spot & Eat. After the order/booking is successfully completed, Spot & Eat pays the partner their earnings minus the Spot & Eat platform fee. Partners are responsible for preparing and providing the goods/services; Spot & Eat provides the technology, support, and payment facilitation.

3) Accounts & Eligibility

  • Users must provide accurate information and keep it updated.
  • Users are responsible for safeguarding account access.
  • You must be at least 18 years old to place orders/bookings.

4) Orders, Bookings, and Fulfillment

  • Partners control availability and may accept/decline requests.
  • Once confirmed, orders may enter preparation and may not be cancelable.
  • Partners are responsible for preparation, quality, and compliance with applicable laws.

5) Payments, Fees, and Payouts

  • Customers pay at checkout through Spot & Eat.
  • Partners receive payouts after completion, minus applicable platform fees and adjustments (refunds/chargebacks).
  • Payouts are typically initiated within 2–5 business days after completion, subject to payment processor rules, verification, fraud/risk checks, dispute/chargeback review, and reserves/holds.
  • Spot & Eat may delay or hold payouts when elevated risk or pending disputes exist.

6) Refunds and Cancellations

Refunds/cancellations are governed by the Cancellation & Refund Policy and any partner-specific terms shown at checkout. Where there is a conflict, checkout terms control.

7) Disputes & Chargebacks

If a dispute/chargeback is filed, Spot & Eat may submit evidence including order details, communications, delivery proof, timestamps, and the policies accepted at checkout.

8) Prohibited Conduct

You agree not to:

  • Provide false information or impersonate others
  • Bypass the platform to avoid fees
  • Abuse, harass, or threaten others
  • Interfere with platform security or operations

9) Third-Party Services

We may use third-party providers (payments, delivery, messaging). We are not responsible for outages or actions beyond our control.

10) Disclaimers & Limitation of Liability

The platform is provided “as is” and “as available.” To the fullest extent permitted by law, Spot & Eat is not liable for indirect or consequential damages. Total liability for any claim related to a transaction is limited to the amount paid for that transaction.

11) Termination

We may suspend or terminate accounts for violations, fraud, abuse, or risk concerns.

12) Changes

We may update these Terms. Continued use means acceptance.

RISK & OPERATIONS

Owner: Spot & Eat Operations

A) Business Model

Spot & Eat is a marketplace platform that connects customers with independent restaurants, food trucks, and venues. Customers place and pay for orders/bookings through Spot & Eat. After the order/booking is successfully completed, Spot & Eat pays the partner their earnings minus the Spot & Eat platform fee. Partners are responsible for preparing and providing the goods/services; Spot & Eat provides the technology, support, and payment facilitation.

B) Partner Onboarding & Verification

  • Collect business identity and contact information
  • Verify payout account details
  • Require Partner Agreement acceptance (including reserves/holds and clawbacks)

C) Payment Flow & Payout Timing

  • Customers pay at checkout.
  • Payouts are initiated after completion, typically 2–5 business days, subject to:
     
    • Processor rules
    • Fraud/risk checks
    • Verification status
    • Dispute/chargeback review
    • Reserves/holds for new or higher-risk partners/orders

D) Proof of Fulfillment (Evidence)

Stored per transaction:

  • Order/booking details, timestamps, confirmations
  • Partner acceptance and completion confirmation
  • Customer communications (when available)

Delivery evidence (when applicable):

  • Courier completion status
  • Photo proof at drop-off (when available)
  • Signed receipt/name confirmation for catering (when available)
  • GPS/time stamps (when available)

E) Refund Rules

  • Public Cancellation & Refund Policy applies, plus any checkout terms.
  • 48-hour non-refundable rule applies to catering/events/scheduled services.

F) Dispute / Chargeback Handling

  • Customers are directed to Spot & Eat Support first.
  • If a dispute/chargeback is filed, Spot & Eat responds with transaction records and evidence.

G) Fraud & Risk Controls

  • Automated flags: high order value, abnormal frequency, mismatched location, repeated failed payments
  • Manual review for large orders over [set threshold, e.g., $500+]
  • Reserves/holds for new partners until successful history is established
  • Elevated dispute rates trigger additional verification, payout delays, or removal

H) Reserves & Clawbacks (Contract Summary)

  • If a refund/chargeback occurs after payout, Spot & Eat may deduct the amount from future payouts or invoice the partner.
  • Partners must cooperate and provide requested evidence within [48 hours].

I) Support SLA

  • Response target: [24–48] business hours
  • Priority handling for non-delivery and event-date issues
